Please read these Terms of Service ("Terms") carefully before using OnlyGainsTV ("Service") operated by OnlyGainsTV ("us", "we", or "our").
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Accounts
When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation.
You must be at least 13 years of age to use this Service. By using this Service you represent and warrant that you meet this requirement.
2. Subscriptions & Payments
Some parts of the Service are billed on a subscription basis or as a one-time purchase. You will be billed in advance on a recurring basis for subscriptions. Billing cycles are set on a monthly basis.
All payments are processed by Stripe. By providing your payment information you authorize us to charge the applicable fees to your payment method. Subscriptions automatically renew unless cancelled before the renewal date.
Refunds are issued at our sole discretion. Contact us at support@onlygainstv.com within 7 days of a charge if you believe a refund is warranted.
3. User-Uploaded Content
You retain ownership of content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display that content solely to operate the Service.
You are solely responsible for the content you upload. You agree not to upload content that:
- Infringes any third-party intellectual property rights
- Contains nudity, graphic violence, or illegal material
- Harasses, threatens, or defames any person
- Violates any applicable law or regulation
We reserve the right to remove any content that violates these Terms at any time without notice.
4. DMCA / Copyright
We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a notice to dmca@onlygainstv.com with: (1) identification of the copyrighted work, (2) identification of the infringing material and its location, (3) your contact information, (4) a statement of good faith belief, and (5) a statement of accuracy under penalty of perjury.
5. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
6. Limitation of Liability
To the maximum extent permitted by law, OnlyGainsTV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, arising out of your use of the Service.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Governing Law
These Terms shall be governed by the laws of the United States without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.
